These Terms and Conditions govern your use of the TAN online store, hosted on Shopify. By accessing our website or completing a purchase, you agree to be bound by these Terms.

1. ELIGIBILITY

By using this site, you represent that you are at least 18 years of age or the age of majority in your jurisdiction.

2. USER ACCOUNT

  • When creating an account, you agree to provide accurate, current, and complete information.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • TAN is not responsible for unauthorized access resulting from customer negligence.

3. PRODUCTS, SIZING & DESCRIPTIONS

  • We strive to ensure that all product descriptions, images, and pricing are accurate. However:

    • We reserve the right to correct pricing errors at any time.

    • We reserve the right to cancel orders if inaccuracies are discovered.

    • Product colors may vary slightly due to lighting and screen settings.

Sizing Disclaimer

  • Customers are solely responsible for reviewing the size chart before purchasing.

  • Fit may vary depending on body shape, proportions, and personal preference.

  • TAN does not guarantee specific fit expectations.

  • Because all items are final sale, we do not offer returns or exchanges due to sizing issues.

4. PAYMENTS

  • We accept payments through secure third-party payment providers integrated with Shopify.

  • All payments must be authorized and received before orders are processed.

  • TAN does not store credit card information on its servers.

5. ORDER ACCEPTANCE & CANCELLATION

  • TAN reserves the right to refuse or cancel any order at our sole discretion, including but not limited to:

    • Suspected fraud

    • Chargeback history

    • Pricing errors

    • Inventory discrepancies

    • Suspicious activity

  • If an order is canceled after payment is processed, a refund will be issued to the original payment method.

6. FINAL SALE POLICY

Due to the intimate nature of swimwear and for hygiene protection standards, all purchases are final sale.

  • TAN does not accept returns, refunds, or standard exchanges.

  • In the event of an extreme or extraordinary situation, TAN may review a request at its sole discretion. Approval is not guaranteed.

Exception Approval Guidelines

If an exception is approved:

  • Items must be new, unworn, unwashed, with hygiene liners intact.

  • Items must be free of makeup, deodorant stains, fragrance, body oils, or any visible wear.

  • Items must be returned in original packaging.

  • Customer is responsible for all return shipping costs.

  • No monetary refunds will be issued under any circumstance.

  • Approved cases will receive store credit only.

All sale, promotional, or discounted items are strictly final sale.

By completing a purchase, you acknowledge and agree to this policy.

7. SHIPPING & DELIVERY

Order Processing:

  • Orders are processed within 5-12  business days, excluding weekends and holidays.

  • Delivery timeframes depend on the shipping carrier and destination.

  • TAN is not responsible for delays caused by the carrier.

Address Accuracy:

  • Customers are solely responsible for entering accurate and complete shipping information at checkout.

  • TAN is not liable for:

    • Incorrect or incomplete addresses

    • Missing apartment or unit numbers

    • Packages returned due to address errors

    • Orders delivered to incorrectly entered addresses

  • If a package is returned due to address errors, the customer is responsible for additional shipping fees to reship the order.

  • Shipping fees are non-refundable.

Lost, Stolen, or Damaged Packages:

  • Once a package is transferred to the carrier, TAN is not responsible for lost, stolen, delayed, or damaged packages.

  • If tracking shows “Delivered” but the package cannot be located, customers must contact the carrier directly to file a claim.

8. FIT, CARE & PRODUCT USE

Proper care is essential to maintain the quality and longevity of swimwear.

We recommend:

  • Hand wash only

  • Cold water

  • Mild detergent

  • Lay flat to dry

  • Avoid rough surfaces

TAN is not responsible for damage resulting from improper care, washing, excessive friction, chlorine exposure, tanning oils, or general wear and tear.

9. CHARGEBACKS & FRAUD PREVENTION

  • By placing an order, you agree not to initiate fraudulent chargebacks.

  • If a chargeback is filed without first contacting TAN, we reserve the right to:

    • Submit evidence to the payment processor

    • Block future purchases

    • Take necessary action to recover funds

  • Fraudulent disputes may be reported.

10. INTELLECTUAL PROPERTY

  • All content on this website — including logos, designs, product images, graphics, branding elements, and text — is the exclusive property of TAN.

  • Unauthorized reproduction, copying, or distribution is strictly prohibited.

11. LIMITATION OF LIABILITY

  • TAN shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or products.

  • Our maximum liability shall not exceed the amount paid for the purchased product.

12. MARKETING COMMUNICATIONS

  • By providing your email address at checkout, subscribing to our newsletter, or entering your email anywhere on our website, you expressly consent to receive marketing communications from TAN.

These communications may include:

  • Promotional offers

  • Product launches

  • Restock notifications

  • Exclusive discounts

  • Brand updates

  • Consent to receive marketing communications is not a condition of purchase.

  • You may unsubscribe at any time by clicking the “unsubscribe” link included in our emails.

13. MODIFICATIONS

  • TAN reserves the right to update or modify these Terms & Conditions at any time without prior notice.

  • Changes take effect immediately upon posting on our website.

14. COMPLIMENTARY TANNING SAMPLE

From time to time, TAN may include a complimentary tanning sample with certain orders as part of a promotional offering. This item is provided free of charge and is not sold as part of the purchase. A minimum order of $60.00 or more is required to be eligible for the complimentary tanning sample.

By accepting this complimentary item, the customer acknowledges and agrees that TAN is not responsible for any allergic reactions, skin sensitivities, skin irritation, or adverse effects that may occur from the use of this product.

Customers are strongly encouraged to perform a patch test prior to full application and to discontinue use immediately if any irritation occurs. Use of the product is at the customer's own discretion and risk.

The complimentary tanning sample is not intended for resale and may be modified, replaced, or discontinued at any time without notice.

Complimentary promotional items are not eligible for return, exchange, replacement, or refund.
